Naming Conventions – This is to label each of the terms used on BladesWork Unlimited , including the website domain www.bladeswork.com (hereinafter referred to as “BladesWork Unlimited”). “You”, The Purchaser, or Customer will be used to label the individual customer buying or browsing this site. “Us”, “We,” or “BladesWork Unlimited” is used to label the company/website/organization as a whole providing access to this site and refers to BladesWork Unlimited.  “Venders”, “blade smiths”, or “sellers” will be used to label the person(s) selling products on this site. Product – used to label each item listed on BladesWork Unlimited. Lead time – in reference to the blade smith’s wait/build period. EX: Lead time of Six (6) months means from the date of purchase, the item will be delivered to the customer’s address no later than six (6) months from the date of purchase. 

This contract sets out your rights and responsibilities when you use bladeswork.com, so please read it carefully. By using any of our Services (even just browsing our website), you’re agreeing to the Terms. If you don’t agree with the Terms, you may not use our Services. 

Your access and use of the site is also subject to all stipulations within this document (“Terms and Conditions”) and all applicable laws. By accessing and browsing the site, you accept, without limitation or qualification, the Terms and Conditions and acknowledge that any other agreement does not apply. You acknowledge that BladesWork Unlimited will use your information in the United States and any country the blade smith’s account is active in. Please be aware that the privacy laws and standards in certain countries, including the rights of authorities to access your personal information, may differ from those that apply in the country in which you reside.

*DISCLAIMER*

By placing an order for any product on this site, you certify that he or she is of legal age (18) and the product ordered will not be used in an unlawful manner. We and the blade smiths on this site assume NO responsibility for the use of the product, for any harm or injury or death resulting from the use and sale of the product purchased on BladesWork Unlimited (BWU). It is the responsibility for you, the customer, to be fully aware of and to comply with all applicable local, state, federal, and country or any international laws in regards to the use of, possession of, and the purchasing/shipping of the products provided on BWU. Absolutely NO refund will be given in the unfortunate event that the product you have ordered was therefore seized by customs or any other agency. If you are uncertain about the laws in your area, consult with your local, state, federal or international laws in regards to any doubt when purchasing your product. BladesWork Unlimited shall be held blameless for any infraction of laws by the purchaser or the vendor. For example, New York City specifically has strict laws regarding our shipping products to their city. We do not ship locking folding knives to New York City. We will ship our other products such as kitchen cutlery, flashlights, etc. This situation is beyond our control. Products sold on BWU are dangerous and if used improperly could result in death or serious bodily harm.

Terms of Use

Sanctions Policy: This policy is a part of our Terms of Use. By using any of our Services, you agree to this policy and our Terms of Use.

As a global company based in Virginia, US, with predicted operations in other countries, BladesWork Unlimited must comply with economic sanctions and trade restrictions, including those implemented by the Office of Foreign Assets Control (“OFAC”) of the US Department of the Treasury. This means that BladesWork Unlimited or anyone using our Services cannot take part in transactions that involve designated people, places, or items that originate from those places, as determined by agencies like OFAC.

This policy applies to anyone who uses our Services, regardless of their location. It is the responsibility of the user to familiarize themselves with these restrictions.

For example, these restrictions generally prohibit, but are not limited to, transactions involving:

Certain geographic areas, such as Crimea, Cuba, Iran, North Korea, and Syria, or any individual or entity operating or residing in those places;

Individuals or entities identified on sanctions lists such as OFAC’s Specially Designated Nationals (“SDN”) List or Foreign Sanctions Evaders (“FSE”) List;

Nationals of Cuba, regardless of location, unless citizenship or permanent residency outside of Cuba has been established; and items originating from areas including Cuba, North Korea, Iran, or Crimea.

Further, BladesWork Unlimited, as a company sanction-compliant policy, will, under no circumstances, allow a vendor located in Pakistan to operate in the marketplace, nor will any products or products generated utilizing materials from Pakistan be sold to buyers using our Services.

In order to protect our community and marketplace, BladesWork Unlimited takes steps to ensure compliance with sanctions programs. If we have reason to believe you are operating your account from a sanctioned location, such as any of the places listed above, or are otherwise in violation of any economic sanction or trade restriction, we may suspend or terminate your use of our Services. Members are generally not permitted to list, buy, or sell items that originate from sanctioned areas. This includes items that pre-date sanctions, since we have no way to verify when they were actually removed from the restricted location. BladesWork Unlimited reserves the right to request that sellers provide additional information, disclose an item’s country of origin in a listing, or take other steps to meet compliance obligations. We may disable listings or cancel transactions that present a risk of violating this policy.

In addition to complying with OFAC and applicable local laws, BladesWork Unlimited members should be aware that other countries may have their own trade restrictions and that certain items may not be allowed for export or import under international laws. You should consult the laws of any jurisdiction when a transaction involves international parties.

BladesWork Unlimited may also retain, preserve, or release your personal information to a third party in the following limited circumstances: in response to lawful requests by public authorities, including to meet legitimate national security or law enforcement requirements; to protect, establish, or exercise our legal rights or defend against legal claims, including to collect a debt; to comply with a subpoena, court order, legal process, or other legal requirement; or when we believe in good faith that such disclosure is reasonably necessary to comply with the law, prevent imminent physical harm or financial loss, or investigate, prevent, or take action regarding illegal activities, suspected fraud, threats to our property, or violations of BladesWork Unlimited’s Terms of Use. In these cases, our use of your information may be necessary for the purposes of our or a third party’s legitimate interest in keeping our Services secure, preventing harm or crime, enforcing or defending legal rights, or preventing damage. Such use may also be necessary to comply with a legal obligation, a court order, or to exercise or defend legal claims. It may also be necessary in the public interest (such as to prevent crime) or to protect vital interests (in rare cases where we may need to share information to prevent loss of life or personal injury).

If BladesWork Unlimited receives a lawful, verified request for a member’s records or information in one of the limited circumstances described in the previous paragraph, BladesWork Unlimited may disclose personal information, which may include, but may not be limited to, a member’s name, address, phone number, email address, and company name.

BladesWork Unlimited is powered by WordPress and eCommerce. The eCommerce coding/dashboard/ accounts are powered by WCFM by WC Lovers.  Agreeing to these terms on BladesWork Unlimited means you have read and understand and agree with the terms and policies for WordPress and WC Lovers. Buying and Selling: As part of the buying and selling process, BladesWork Unlimited will facilitate the sharing of information between the two members involved in the transaction, such as the other BladesWork Unlimited member’s shipping address and payment status. This may also involve us sharing your information with some of our third-party partners such as our shipping and payment partners to enable us to provide the service to you. By making a sale or a purchase on BladesWork Unlimited, you are directing us to share your information. Since this is an important part of the Services we provide, we need to do this in order to perform our obligations under our Terms of Use. We expect you to respect the privacy of the member whose information you have received. As described in BladesWork Unlimited’s Terms of Use, you have a limited license to use that information only for BladesWork Unlimited-related communications or for BladesWork Unlimited-facilitated transactions. BladesWork Unlimited has not granted a license to you to use the information for unauthorized transactions or sending unsolicited commercial messages in violation of any applicable laws, including any consent requirements of the jurisdiction of the recipient. You may only add a member to your email or physical mailing list or otherwise use or store a member’s personal information in accordance with applicable laws, including any consent requirements that apply in that member’s jurisdiction.

Registration, Account Setup, Service Usage: In order to use the Services, you need to provide us with a valid email address, and for Services that require registration, a name associated with your account that you can choose to represent your identity on BladesWork Unlimited. You may review, change, or remove that name through your account settings. You must provide this information to enable us to provide you with the Services and products. Depending on which services you choose to use, additional information, such as a shop name, billing and payment information (including billing contact name, address, telephone number, credit card information), a telephone number, and/or a physical postal address, may be necessary in order for us to provide a particular service. You are not required to provide us with this information to sign up, but we will need it to provide certain services. For example, we need a physical postal address if you are buying something on the Site for delivery. Depending on your local jurisdiction, you can also choose to allow us to save your credit card information to facilitate the checkout process for future purchases. BladesWork Unlimited may contact individual shop owners confidentially to request more information about their shops or items listed through the Services, or to ensure compliance with our rules and applicable law. 

The name associated with your account, which you may review and change in your account settings, is publicly displayed and connected to your BladesWork Unlimited activity. Other people may see the date you joined; ratings, reviews, and related photos for products you purchased or sold; your profile information; items you listed for sale; your shop pages and policies; your Favorites, followers, and those you follow; sold item listings and the number of items sold; comments you post in our community spaces; and information you decide to share via social networks.

Depending on your location, you may also have certain additional rights with respect to your information, such as: (1) data access and portability (including the right to obtain a copy of your personal data you provided to BladesWork Unlimited, via your settings); (2) data correction (including the ability to update your personal data, in many cases via settings); (3) data deletion (including the right to have BladesWork Unlimited delete your personal information, except information we are required to retain, by contacting us).

We partner with third parties to manage our advertising on other sites. Our third-party partners may use cookies or similar technologies in order to provide you with advertising based upon your browsing activities and interests. If you have chosen to connect your account to an external third-party application, such as Facebook, or an app developed using the API, you can change your settings and remove permission for the app by changing your account settings.

Product Pricings: Each blade smith has the right to determine the pricing of their own product in accordance with their own judgment. Prices shown do not reflect tax or shipping costs which will be included in total on the checkout page. Haggling or any sort of pricing debates will not be tolerated on BladesWork Unlimited (BWU). All prices are final unless the bladesmith themselves decide to change the price at their discretion.  The Bladesmith will not, however, adjust the price of product after sale has been agreed upon. Coupons are accepted and will be available at the bladesmith’s prerogative.  

Product Pricing Reviews: BWU will review all prices posted on individual and group vendor profiles.  BWU reserves the right to conduct a full product review in the event product pricing is found to be exorbitant.  Exorbitant can be defined as outside the bounds of reasonable market valuation.  A full product review will require the Bladesmith to submit a listing of material(s) used, pricing of each material(s), and approximate cost of labor as valued in a price/labor hour model.  Should BWU determine exorbitant pricing, the vendor will submit a revised pricing analysis within five (5) days or face a fifteen (15) day suspension.  Non-compliance or failure to adhere to pricing reviews will result in further suspension/cancellation of vendor accounts.  BWU understands that custom product pricing is a fluid business and is willing to work with vendors to ensure a positive experience is had by all parties.

Shipping: Shipping will always be free if you reside in the United States. If you buy an item from a bladesmith, this item will be processed and shipped at the bladesmith’s earliest convenience but are not to extend two (2) business days during the business week unless specific guidance is given on both the vendor and the customer side. Expect shipping delays if an item is ordered on a non-business day or holidays. All shipping rates during holiday periods will be greater than the normal shipping amount due to the increase of rates from the shipping companies. IN ORDER TO ENSURE NO PRODUCT ENDS UP IN THE WRONG/UNDERAGE HANDS EACH PACKAGE DELIVERED WILL REQUIRE A SIGNATURE FROM THE BUYER, in order to verify that the customer is of legal age. BWU and vendors do not accept any responsibility for packages delivered to wrong/underage person(s). By you, the buyer, purchasing a product from BWU’s marketplace, you verify that you are of the legal age to purchase this product and accept all risk pertaining to this item. You are also responsible for understanding your local laws pertaining to the product you are buying. BladesWork Unlimited and the bladesmiths are not responsible and accept no risk with you purchasing a product and then being unable to receive the product at the time of delivery or after the delivery being seized by local authorities based on your local laws.

International Shipping: As stated in the disclaimer, when purchasing a product, you must be aware of your local country/state/country/county or any local laws pertaining to the product you purchase. BladesWork Unlimited and the bladesmiths do not accept any responsibility for a product seized at customs or any other government agencies dealing with shipping items nationally or internationally. If that item is seized, you will not be entitled to a refund for the price of the product as well as the shipping costs. To ensure this does not happen, review the local laws concerning the products you are purchasing prior to purchasing a product.

Finally, BladesWork Unlimited members should be aware that third-party payment processors, such as PayPal, may independently monitor transactions for sanctions compliance and may block transactions as part of their own compliance programs. BladesWork Unlimited has no authority or control over the independent decision-making of these providers.

The economic sanctions and trade restrictions that apply to your use of the Services are subject to change, so members should check sanctions resources regularly. For legal advice, please consult a qualified professional.

*Privacy Policy*

We need to process your personal information to run our business and provide you with the Services and products. By accepting our Terms of Use, you are confirming that you have read and understand this policy, including how and why we use your information. If you don’t want us to collect or process your personal information in the ways described in this policy, you shouldn’t use the Services. We are not responsible for the content or the privacy policies or practices of any of our members, third-party websites, or third-party apps.

*LEGAL AGE USE*

BladesWork Unlimited Terms of Use require all account owners to be at least 18 years of age. Minors under age 18 are not permitted to use BladesWork Unlimited or the Services. You are responsible for any and all account activity conducted by a minor on your account.

 

*FOR THE VENDOR*

By creating a profile and listing products, the bladesmith accepts and agrees to ALL terms and conditions stated in this document. BladesWork Unlimited is not responsible for any shipping, broken or missing products, damage which occurs during shipping, or any other matter pertaining to the item itself. BWU is strictly giving the blade smith access to a secure site which enables the blade smiths to manage orders, accept funds legally and able to track progress of funds and sales, and to provide a professional experience/site for the blade smith to sell products. All businesses fail without bottom up refinement, if any blade smith has recommendations for improvements or sustains for the site, all concerns and suggestions will be reviewed and considered.

Pricing and fees: BladesWork Unlimited (BWU) is a free to use site for anyone, with our basic Carbon package. There are no monthly fees and $0 paid to BWU until a sale is made. Upon creating a profile, all venders agree to pay BWU a 15% commission fee each time a product is sold from their profile. All payments are processed through PayPal and are subject to PayPal terms and conditions. Automatic deductions in this amount will occur at the time of the sale. For example: A product sells for $100 USD, the vender receives $85 and BWU receives a commission of 15% for $15 USD. 

Carbon Package: $0 per month with 15% commission

Stainless Package: TBD with 12% commission

Damascus Package: TBD with 10% commission

The current package available is our carbon package with $0 monthly subscription and 15% commission fee.

We reserve the right to change this amount at any time without any notice to the venders. If there is an adjustment to these terms and conditions, all venders will be made aware and be asked to review at their own leisure. We are not responsible for ensuring all venders know about the changes. There are no hidden fees on BWU. All international sales are subject to PayPal’s processing fees which can be found here: https://www.paypal.com/us/webapps/mpp/merchant-fees. BladesWork Unlimited does not accept any responsibility and will not refund any fees due to vendor misunderstanding. In order to use BladesWork Unlimited, the vendor MUST have a PayPal account established.

Withdrawal of Funds: Blade smiths will have access to request withdrawal and will be able to transfer all funds into their bank accounts after the order is processed and completed and the status in the process order is marked as completed. There is no limit requiring the blade smith to withdraw the funds or vice versa. Upon shipping the product, the blade smith will change the status of the order in their profile to complete and will have access to withdraw the funds in the account. If funds are withdrawn prior to the status being changed to complete or prior to the shipping of said products, the bladesmith will receive a warning from BWU. If this happens again, the bladesmith’s profile will be suspended for fifteen (15) days in which he/she will not be able to sell items on BWU. This policy ensures the handling of monetary transactions is both professional and transparent. By creating a profile, the bladesmith agrees to these terms and conditions. Exceptions to these terms will only be considered with proof of written coordination with the seller and the buyer. Reminder: Upon requesting withdraw, BWU will receive a 15%, 12%, or 10% commission fee from each transaction based on the subscription package.. BWU will payout all withdraw requests on each Thursday of every week. Transactions will appear within (1) business day into the account of your choosing, as annotated in your vendor profile. 

Photo/Description Policy: It is important that we lay out the photographic expectations for our bladesmiths. Though it may seem trivial, photo quality and an accurate, detailed product description will enable blade smiths to sell more items. Low quality images will not be accepted, and the product will be removed from the published status and sent to review back to the bladesmith. Photos are not to exceed 2MB and will contain absolutely no hands, foreign objects, vehicles or any other items not pertaining to the product itself. Acceptable photo backgrounds are scenic or of standard, solid colors. Unprofessional items such as vehicles, dashboards, playsets, tables, roads, couches, carpet, countertops (unless extremely beautiful and compliments the product) will not be accepted and will be sent back to the bladesmith to review and edit the photo. We are not responsible for taking photographs of the products, it is the responsibility of the bladesmith. Photographs of the products with good backgrounds emphasize the quality of the product each bladesmith sells. If the bladesmith needs or has any concerns about quality or photographs, email the administrative point of contact from the dashboard and BWU will address the issue. The quality of an item begins with the preparation. Blurry items do not sell. Product descriptions will be detailed and describe the products to the best of the bladesmith’s ability. Each product description will include length and width of the product as a whole and of the cutting edge itself. This will help the customer on deciding to purchase a product that complies with the local/state/country laws. Refer to the example product for examples of good/bad product’s published. BWU reserves the right to remove any product based on photography and descriptions.

Selling Made-To-Order Products: Made-To-Order custom products are highly encouraged and facilitated through BladesWork Unlimited’s marketplace. Most bladesmiths do not have a lot of inventory and items are sold quickly. To ensure ease and speed of custom product facilitation, the following process will occur: 

Each blade smith will have the design/mockup of the product on his/her profile with the quantities available according to the bladesmith’s lead time which matches the bladesmith’s time to deliver. It is not incumbent on bladesmith to specifically tell each customer purchasing this item to review the lead time. The lead time will be posted in the item description as well as the bladesmith’s profile. Custom product design requires forecasted raw materials costs on the vendor.  Due to the nature of custom orders, it is the responsibility of the vendor to provide both a Materials Deposit Price and a Final Product Price. A product may be added with the deposit option selected. The smith must state on the product page the estimated date of availability. The deposit amount is determined by the smith. BladesWork takes no responsibility in issuing the reimbursement but will work with the smith if there are any issues and resolve them. It is up to the vendor to issue their own refund policy.

Please note, making a hand-forged/handmade product takes a substantial amount of time. If you are not satisfied with the bladesmith’s lead time, BWU recommends you do not purchase this product. If the lead-time expires with no contact from the bladesmith to finalize the order within two (2) days of the lead time expiring, you will be authorized a full refund of your deposit. BladesWork Unlimited will not be held responsible for the refund of said products and the 15% commission fee and transaction fee will not be refunded at the bladesmith’s expense. In other terms, if the bladesmith contacts you, the buyer, with no response within thirty (30) days, the blade smith is authorized to retain all deposits for the item and list the item for sale for a price of his/her choosing. 

Information Privacy: As a vendor, you will have access to the customer’s personal information, such as name and shipping address. This information is not to be sent or used in any third-party sites or for any other reason not pertaining to the shipment of the product. You are responsible for protecting this information in accordance with the legal requirements and privacy policy. You may not use this information for unsolicited commercial messages or unauthorized transactions.
